Understanding the accredited investor requirements
Thinking about investing in a Delaware Statutory Trust? First, you’ll need to know if you qualify as an accredited investor.
Here’s how it works.
For individuals and revocable living trusts, there are two ways to qualify: by net worth, or by income.
Option one:
A net worth of at least one million dollars, not counting the equity in your primary residence.
Option two:
Income of at least two hundred thousand dollars in each of the last two years, or three hundred thousand if combined with your spouse, and you expect to earn the same or more this year.
What if you’re investing through a corporation or an LLC?
The rules are a little different.
- Entities like corporations and LLCs can qualify with a net worth of at least five million dollars.
- If the entity doesn’t meet that threshold, it can still qualify through a pass-through test, as long as every individual member is accredited under the same net worth or income rules we just covered.
- Irrevocable living trusts must have at least five million dollars to qualify.
Individuals need one million in net worth or qualifying income. Entities need five million or fully accredited members. Irrevocable trusts need five million.
